User account

You need an account to access the course on our site, which requires you to provide accurate and complete information, including a valid email address. Your account is your responsibility, which means you need to take care of your password. You may not transfer your account to anyone else or use someone else’s account either.

If you contact us to request access to an account, you will not be granted access until you provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will be closed.

You may not share your account login details with anyone else. You must notify us immediately if you discover that someone else may be using your account without your permission. If this does happen, we recommend you change your password.

You can terminate your account at any time.

Course enrolment

When you enrol in a course you receive a license from us to view it via Bowfin Property Courses. You are generally granted lifetime access to courses with a one-time payment. Whereas subscription courses require the recurring subscription payment to be paid to retain access to the course. If the payment is cancelled, access to the course will cease too.

Payments and refunds

When you make a payment, you agree to use a valid method of payment. If you are not happy with the course you chose or if the content is not what you were expecting, Bowfin you can request refund within 30-days of your purchase of the content. Your refund will be credited back to the same payment method used to pay for the course. Bowfin operate payments through a secure Payment Gateway, which uses Stripe and PayPal payment methods.

No refund is due to you if you request the refund after the 30-day guarantee time limit has passed.

To request a refund, simply send an email to support@bowfin.co.uk with your order number, which can be found on your original email you received when you signed up to the course.

We reserve the right to disable access to the course material if you use an invalid or unauthorised method of payment.

Disclaimer

It can happen that our website goes down, which may or may not be under our control. This could be for planned maintenance, due to a fault somewhere with our site or a problem with our hosting provider. When this happens, we always endeavour to get our site back up and running as soon as possible, and we would appreciate your patience if this happens. You may find you'll need to log back into your course if this does happen.

In the event this happens when you are trying to access a course, or if it happens when you are viewing a course, you accept that you will not have any recourse against us in any of these types of cases where things don’t work out right.

We (and our employees, affiliates, suppliers, partners, and agents) make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We (and our affiliates, suppliers, partners, and agents) make no warranty that you will obtain specific results from use of the Services. Your use of the Services (including any content) is entirely at your own risk. Some jurisdictions don’t allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

We reserve the right to cease making available certain features of a course or services at any time and for any reason. Under no circumstances will Bowfin or its employees, affiliates, suppliers, partners or agents be held liable for any damages due to such interruptions or lack of availability of such features.

We are not responsible for delay or failure of our performance of any of the Services caused by events beyond our reasonable control, like an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions.

Limitation of liability

There are risks inherent to using our Services, and where these risks exist you fully accept these risks. You agree that you will have no recourse to seek damages against us if you suffer loss or damage from using our Services.

To the extent permitted by law, we (and our companies, employees, suppliers, partners, and agents) will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability, or otherwise, and even if we’ve been advised of the possibility of damages in advance. Our liability (and the liability of each of our group companies, suppliers, partners, and agents) to you or any third parties under any circumstance is limited to the greater of one hundred dollars ($100) or the amount you have paid us in the twelve (12) months immediately prior to the event that gave rise to your claim. Certain jurisdictions do not permit the exclusion or limitation of liability for consequential or incidental damages, which means the above may not apply to you.

Governing law and jurisdiction

These terms are governed by the laws of England and Wales, UK, and you are contracting with Bowfin Limited. You may not assign or transfer these terms, but we may assign these terms to another company or person without restriction.

Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. You agree that your account is non-transferable and that all rights to your account and other rights under these Terms terminate upon your death.

Most disputes can be resolved before the need to involve a legal case, so we recommend you Contact Us in the first instance to try resolving your dispute.

Updating these terms

From time to time we may update these Terms to reflect new services, practices or new laws. Bowfin reserves the right to update, modify or make changes to these Terms at any time. If we make any material changes, we will notify you by using your registered email address.

Your continued use of our Services after any changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
